End-of-waste status

When applying for loss of waste status, the criteria set out in Art. 14 of the Waste Act or regulations specifying the detailed conditions for the loss of waste status.

Loss of waste status has recently been a very interesting topic for discussion and a challenge, in particular for waste for which detailed requirements have not been defined. Many entrepreneurs have waste which, as a result of the treatment process, can potentially apply for the loss of the waste status. However, the problem is the regulations, and more precisely the lack of detailed executive acts. In fact, only for a very small group of waste, legal acts have been developed at the level of EU regulations that specify what standards waste should meet in order for it to lose its waste status. They include e.g. glass cullet, scrap or copper scrap. The following regulations have been published in Polish legislation:

  • Regulation of the Minister of Climate and Environment of November 8, 2021 on determining the detailed conditions for the end-of-waste status for reclaimed asphalt waste (Journal of Laws 2021, item 2067),
    The regulation applies to waste code 17 03 02
  • Regulation of the Minister of Climate and Environment of 27 October 2022 on defining detailed conditions for the loss of waste status for waste generated in the process of energy combustion of fuels (Journal of Laws 2022, item 2330).
    The regulation applies to waste codes: 10 01 01, 10 01 02, 10 01 03, 10 01 05, ex10 01 15, ex 10 01 17, 10 01 24, 10 01 80, 10 01 82

The above regulations specify in detail:

  • types of waste used in the recovery process,
  • acceptable processes and techniques for their processing,
  • quality criteria applied to materials generated in the recovery process that have lost their waste status, in accordance with the adopted product standards,
  • requirements related to quality control and self-monitoring,
  • assessment requirements and end-of-waste compliance statements.

In the event of end-of-waste, please note that:

  • permits for waste processing should contain a provision referring to the loss of waste status as a result of its processing,
  • joint storage of waste and items or substances that have lost their waste status is prohibited.
